A disciplinary hearing is a formal stage in a process that may already have involved investigation, suspension, and significant organisational anxiety. Preparation is what separates a procedurally sound hearing from one that creates avoidable challenge later.

Review the investigation outcome

Before the hearing is convened, decision-makers and HR should review the investigation report, evidence bundle, and disciplinary policy to confirm the allegations are clearly framed and supported by documented findings of fact.

Confirm procedural arrangements

  • Issue the employee with adequate notice and the case papers in advance
  • Confirm the right to be accompanied and any reasonable adjustments required
  • Agree who will chair the hearing and who will take the decision if different
  • Ensure a clear record of proceedings will be maintained throughout

Where seniority, sensitivity, or prior involvement compromises internal independence, appointing an external hearing chair provides assurance that proceedings will be managed professionally and in line with ACAS principles.
